With the Help of ISFED, Another Citizen Successfully Defends Their Labor Rights
On January 30, 2026, the Kutaisi City Court approved a settlement between the parties in the case of David Kakhidze. Per the court's ruling, the legal proceedings were terminated, and the defendant, LLC Saknakhshiri, was ordered to pay compensation to the plaintiff, Mr. Kakhidze.
David Kakhidze had been employed by LLC Saknakhshiri since September 8, 2020, as a wagon repairer in the mine transport section. He held an indefinite labor contract.
On December 30, 2024, the employee was informed that his employment had been terminated. The employer cited the results of an interview conducted as part of a reorganization as the basis for the dismissal. However, Kakhidze linked his termination to his wife’s membership in an opposition political party.
David Kakhidze appealed the decision in court, arguing that his dismissal lacked legal justification. He requested that the dismissal order be annulled, that he be reinstated to his position, and that he be compensated for forced idle time.
During the court proceedings, the parties reached an agreement. On January 30, 2026, the Kutaisi City Court approved a settlement in which LLC Saknakhshiri committed to paying compensation. Notably, the court ruling set strict deadlines for the payment; should the defendant fail to meet these deadlines, an enforcement writ will be issued immediately.
This case reaffirms that dismissals under the guise of "reorganization" often occur without proper legal justification or objective criteria. In such instances, utilizing judicial mechanisms and reaching fair settlements serves as an important precedent for the protection of labor rights.
