Appellate Court ruled in favor of appellant represented by ISFED
Another success story of ISFED. On July 19, 2016, Kutaisi Appellate Court granted part of the appeal of M.Ch., the appellant represented by ISFED.
M.Ch. participated in a competition announced for selection of Gamgebeli Representative in Ajara Municipality’s Department of Administrative Service Coordination, Kvatskhi Administrative Unit. M.Ch. believed that local commission for selection and certification of municipal employees violated requirements of administrative legislation for interviewing candidates. The commission refused to nominate him for the office, without providing any grounds of the refusal, and announced that the competition was ruined.
ISFED filed in Sachkhere District Court seeking annulment of the competition results. It requested the court to order the respondent to repeat the interview process. The first instance court rejected the claim, which led ISFED to file in Kutaisi Appellate Court. The appellate court granted part of the claim and invalidated decision of Chiatura Commission for Selection and Certification to find the competition ruined and to refuse to nominate M.Ch. for the vacant position. ISFED also ordered the commission to repeat the interview process.
International Society for Fair Elections and Democracy provides legal aid within the project Protecting Rights of Civil Servants for Politically Neutral and Discrimination-Free Public Service in Georgia funded by the Embassy of Netherlands in Georgia. Within the project ISFED provides free legal consultation, representation and prepares legal documents for victims of unfair selection and certification process and dismissals without legal cause in public service.
